Unfair Justice

The concept of unbiased and independent court failed on January 16, 2009. Vakhtang Abuashvili, 28 a patrol was sentenced to two years of prison term for the murder of Giorgi Gamtsemlidze, 31 by Judge Eka Gabrichidze of Collegium for Criminal Cases within Tbilisi City Court. The voice of the judge was trembling when she was reading the final verdict out loud but this will not console the family of deceased Gamtsemlidze. The justice did not prevail for the family. The only hope for them is to appeal the court verdict in the Strasbourg Court and find the truth there.

Seven Years in Prison for Drinking Vodka
Gurjaani district court is judging 28-year-old Amiran Tsertsvadze. Criminal case materials and testimonies of the witnesses interrogated at the trial, expose that very drunken Tsertsvadze swayed into the booth of other person located next to his father’s house and drank vodka. Although the prosecutor blames the accused person for the attempt of thievery because he illegally entered the strange house. Consequently, Tsertsvadze is charged under the criminal code and prosecutor demands 7-year of imprisonment for him.

Court VS Honor and Dignity of Soldier
On November 6, 2008 Gori district court signed plea-bargain with two soldiers who were accused for deserting the army during war operations in August 2008. According to the bargain, initial charge of the soldiers-deserting-was changed into disobedience. The attorneys of the accused people requested plea-bargain. They considered it was the shortest way to gain freedom for detainees in the expectation of the Presidential mercy. On December 17, 2008, on St. Barbare’s Day, soldiers were really pardoned and released. Everybody should have been pleased with the result but pardoned soldiers, Zurab Khorbaladze and Giorgi Meskhi are sure that impartial court should have estimated their innocence. However, the lawyers could not give them guarantee for similar decision and the accused people had to accept status of a guilty and get freedom at the expense of soldier’s honor and dignity. Whilst, they expected the court to protect their dignity.

Eka Jandieri, a resident of Telavi, blames Nino Vakelishvili, director of Telavi Public School # 5, for labor trafficking. Jandieri claims that she has worked at school for one year without any salary. Besides that, deputy director made her to look after her little grandchild and ordered to do various jobs at school.
