ECHR: Fortcoming Chamber Judgements

The European Court of Human Rights will be notifying in writing 47 Chamber judgments on Tuesday 13 January 2009.
 
Aliev v. Georgia (no. 522/04)
The applicant, Abdulhamit Aliev, is a Russian national who was born in 1957 and has been living in Georgia as a refugee since March 1999. His details were circulated by Interpol and he was arrested by the Georgian authorities in May 2002 under an arrest warrant issued by the Russian authorities. He was released in January 2005. Relying on Article 3 (prohibition of inhuman and degrading treatment), the applicant complains in particular of his conditions of detention in Tbilisi no. 5 Prison and of ill-treatment inflicted on him there
 
Giorgi Nikolaishvili v. Georgia (no. 37048/04)
The applicant, Giorgi Nikolaishvili, is a Georgian national who was born in 1981 and lives in Tbilisi (Georgia). Summoned as a witness in a murder case in which his brother was a suspect, Mr Nikolaishvili complains about the unlawfulness of his ensuing arrest. He alleges in particular that the authorities arrested him in order to oblige his fugitive brother to give himself up to the authorities. He relies on Article 5 §§ 1, 3 and 4 (right to liberty and security). Further relying on Article 8 (right to respect for private and family life), he also complains that his photograph as a “wanted person” was publicly posted in police stations.
