The Center for Constitutional Rights Blames City Park for Illegal Fining of Drivers

Nongovernmental organization, the Center for Constitutional Rights protests illegal fines for drivers estimated by the City Park.

Representatives of the Center found out that drivers of evacuated cars are fined illegally by the City Park. According to the Article 125 of the Administrative Code, the personnel of the City Park have right to evacuate a car parked in a wrong place to the restricted territory, but they are obliged to give it back immediately to a car owner as soon as the ID and Car Passport will be represented to them. According to the Center, the law does not estimate the deadline for the payment of fine; it does not oblige the driver to pay the fine before taking the car.

However, the City Park does not allow the drivers to take their cars, until they do not pay 10 GEL as fine and 60 GEL for evacuation. The rights of these citizens are breached as they cannot use their own property. It should be pointed out that the law does not define the right of the representatives of the City Park to establish 60 GEL fine as a compulsory tax and not to return a car until the fine is paid. It is absolutely unclear how the tariff is suitable to the expanses of evacuation of cars to the parking lot,” said the representatives of the organization.

The Center for Constitutional Rights calls upon all drivers not to become victims of illegality, as they have rights to take their own cars from the parking lot and use it as soon as they provide their ID and car documents even if they do not have the fine and evacuation tax paid.
