UN International Court Requests Additional Materials to Continue Discussion of the Suit of Georgia

November 20, 2009

UN International Court in Hague requests additional materials to continue the discussion of the suit filed by Georgia against Russia. Hisashi Owada, the president of the court, stated during the television space bridge with the Russian TV-Company Ria-Novost about it. He added that the suit of Georgia complies with the jurisdiction of UN International Court.

According to Hisashi Owada, after the first discussion, the court agreed to take interim measure in regard with Russia. However, these are not final measures and for the further discussion of the suit it is necessary to provide the court with additional claiming by both parties.

“Georgia submitted the suit in August, 2008. Now we deal with only one aspect of the suit, because Georgia sues Russia, and more precisely lames it in the violation of all forms of racial discrimination. This aspect is about the request of Georgia to take interim measures against Russia and we satisfied it. However, these are not final measures. You know, international convention against torture entitles one party to appeal against another based on one concrete article what in fact happened. Both Georgia and Russia should act in compliance with the international convention against torture. Our decision on interim measures was relied on the compliance with the requirements of the convention. The suit of Georgia really meets jurisdiction of the UN International Court and the court continues its work. We expect the additional arguments of the parties for the next stage”, stated Owada.

The Ministry of Justice of Georgia responded to this statement. According to his information, Georgia has implemented all requests of the court at this stage and waits for Russia to submit respondent’s memorial.
