Only Five MPs Attended Discussion of the Public Defender’s Report At the Session of the Human Rights Parliamentary Committee

On April 21, only five MPs attended the discussion of the Public Defender’s Report of the second half of 2009 at the session of the human rights parliamentary committee. The chairman of the committee Gia Arsenishvili, his deputies Eka Kherkheulidze, MPs from minority - Dimitri Lortkipanidze and two more MPs from ethnic minorities attended the hearing.

As for the report, Gia Arsenishvili said it is quite strict and thinks that results of such a serious monitoring in the penitentiary system and orphanages have not been discussed in the reports for the last two years. However, Gia Arsenishvili thinks the parliament should also listen to the comments of the representatives of the executive authority on the violations discussed in the report. Arsenishvili pointed out that they have some notes about the public defender’s office; though he did not speak about them yet.

Public Defender Giorgi Tughushi speaks about the problems in penitentiary system, orphanages, judiciary systems and in the structures of the ministry of internal affairs. According to the ombudsman, the situation is very poor in jail hospitals; prisoners do not receive newspapers; there is problem of qualified personnel in the custodies.

As for orphanages, Giorgi Tughushi was very strict about the situation in them in his report; he said facts of violent treatment occurs there; however, Giorgi Tughushi underlines that personnel of the orphanages does not think shouting, degrading, etc – the criteria estimated by the World Health Organization – are violent treatment of children and use them as ordinary educational tools.

As for the structures of the MIA, Giorgi Tughushi said investigations are prolonged; law enforcement officers inadequately react on crimes and inadequately treat detainees.
