Where Did “Sandra’s Buses” Disappear?

Zviad Khmaladze Is Selling Out Municipal Transportation

LLC “Gortransavto,” which was seized from its owner Guja Berikashvili by the local government, is being urgently sold out on the auction today. Why is the enterprise concerning which the court made decisions beneficial for its previous owner being sold?! Guja Berikashvili doesn’t want to express his position on this issue. But, a lot more interesting is the fact that Berikashvili himself might participate in the auction. Practically, he will have to purchase his enterprise for the second time.

On September 20th of 2010, #188 decree of City Council chairman will be issued that will determine the additional conditions for privatization of property presented on the auction, bid and the price of the ticket. According to this decree, the winner of the auction will be obligated to restore and maintain the profile of LLC “Gortransavtor” for 5 years. Also, the auction winner is obligated to restore the auto park minimum with one unit of transportation means every year.

Quote from the decree:  “The auction winner is obligated to restore/maintain the existing profile of LLC “Gortransavto” for 5 years. During the period of maintaining the profile, the increase of the current prices of transportation, the addition of new transportation lines and determination of the travel costs on them in the territory of Gori municipality shall occur only with the consent of the chairman of Gori Municipality City Council.”

The capital of company was enriched by the buses brought from the Netherlands in 2004 in December. These buses trafficked without the excise-duty for so long that after 6 months, the fine reached 90 000 GEL. The corresponding money was “paid” to the state budget by the local budget. In the fall of 2007, Tbilisi mayor Gigi Ugulava transferred several units of “dafa” type buses to Gori municipality ownership. Nowadays, these 8 units of auto transportation are taken out of from the statutory capital of LLC “Goravtotrans.” The corresponding information is confirmed by the inferences of audits.

On August 21st, the audit inference of 2010 LLC “Gortransavto” was issued.

The 100 % of LLC “Gortransavto” belongs to Gori Municipality Government. According to the conditions of August 20th of 2010, the statutory capital of enterprise amounted to approximately 402 000 GEL, the undistributed profit - 53 000 GEL. The cost of the buildings amounts to approximately 213 000 GEL. The market price of automobiles and autobuses amounts to 71 900 GEL. 7 Ikarus, 25 Paz, one Ford and One BMW type autobuses, mini buses and cars are included in this list. There is furniture costing 13 650 GEL and inventory including telephone costing 55 GEL and a laptop costing 800 GEL in the enterprise. In sum, according   to audit’s  inference 100 %  share  of  LLC  “Gortransavto”  was   evaluated   to 420 667, 64 GEL consequent from the free market prices.

This inference of audit was sent to chairman of city council by the governor of Gori municipality Davit Khmiadashvili on August 25th of 2010. On the same day, the head of Gori city council Zviad Khmaladze issued decree #141 according to which the 100 % property share of the LLC “Gotransavto” was prepared to be presented to the auction.

We have an earlier audit inference on the evaluation of the property. It dates back to June 25th of 2010. According to this inference, the governor asked for the evaluation of enterprise’s property on June 22nd. According to the corresponding inference, “the property of LLC “Gortransavto” situated in the #49 Tamar Mepe St, Gori, according to audit, considering the market prices, was evaluated to 266 710 GEL.” 187 900 GEL from this amount is envisaged for buildings, and the rest 76 900 – for techniques. In approximately one month, according to new audit inference issued on August 20th of 2010, the price of enterprise is raised up to 212 900 GEL, and the price of technique is reduced to 71 900 GEL (5 000 GEL less).

The main question which is obviously unanswered in this case: Where did 8 units of “Dafa” type so-called Sandra’s autobuses go? Why did the price of buildings and technique change so quickly? According to #126 decree issued by the head of the city council Zviad Khmaladze on August 17th of 2010, “8 units of “DAF-SB220” type autobuses were taken out from the capital of LLC Gortransavto. After taking out of the corresponding property from the statutory capital, the statutory capital of the society should be reduced and instead of 385 250 GEL, 337 250 GEL should be established.”

According to this decree we found out that the statutory capital of LLC “Gortransavto” in the beginning was 337 250 GEL. In the months of September it reached to 421 000 GEL. Both audits were conducted by the same company.

It seemed like everything was ready to conduct the auction, but suddenly Gori Municipality City Council cancelled the announced auction and started preparing for the repeated auction.

“As you know, according to President’s decision, the rule of auction was changed in some ways and consequently it was necessary to make change in the annotation of the decision announced by us. The remaining process of the privatization of enterprise will be carried out as usual,” – stated Zviad Khmaladze to members of city council at the session.

While talking with us, Zviad Khmaladze states that autobuses from Netherlands went back to its owner: “As I know, it never belonged to the municipality. I don’t know to who it is transferred. As for the fact that the city stayed without the municipal transportation, let’s examine the situation. A lot of things can be changed in five years.”

In the newspaper of Gori municipality local government “Goris Matsne” (Gori News) for the second time now the news is spread that “Gortransavto” is being sold out.
