Court Completely Satisfied Request of the Investigation When Imposing Preventive Measures over Individual Entrepreneurs from the Shopping Centers

The request of the investigative department within the Georgian ministry of finances was almost completely satisfied in regard with the detained individual entrepreneurs from the shopping centers “Kidobani” and “Pasaji”. Judge Vazha Pukhashvili at the Tbilisi City Court sentenced 10 accused to pretrial detention as it was requested by the investigation.

The judge also satisfied the request of the investigation to release 8 accused under bail. The only thing which was changed by the judge in the prosecutor’s solicitation was the amount of the bail. The judge reduced the bails at 500 GEL for several accused. 8 accused were bailed from 5 000 to 10 000 GEL.

Those who were detained are the employees of the “Trans Ltd” and those entrepreneurs who imported the goods of more than 7 000 USD in Georgia; those who had imported goods of less than 5 000 USD were bailed.

The accused were charged for the usage of the fabricated documents which envisages imprisonment for 7 years. 36 people were detained in total.

The investigative department of the ministry of finances requested imprisonment for 10 people – among them are the employees of the “Trans Ltd” – and bail from 5 000 to 10 000 GEL for 8 detainees.

The investigation requested to imprison those individual entrepreneurs who had imported goods of more than 7 000 USD but bail for those who had imported goods for less than 5 000 USD. Those who had imported the goods for 8 000 USD were bailed by 5 000 GEL; but the importers of more goods were bailed by 10 000 GEL.

The attorneys did not agree with the request of the prosecutor. They said the prosecutor could not prove the necessity of the preventive measures. The attorneys requested minor preventive measures or release of the detainees.

The attorneys of the “Trans Ltd” do not agree with the accusation either. Their attorney Davit Abesadze said that invoices were prepared in Turkey where the name and price of the goods are indicated. Based on these invoices, “Trans” paid the taxes and the state was not damaged at all.

Judge Vazha Pukhashvili discussed cases of only 18 detainees. They are charged under Article 210 Part II –“e” of the Criminal Code of Georgia which envisages fine or imprisonment from 4 to 7 years.

15 special unit officers of the investigative department of the ministry of finances brought the accused to the court. The court will discuss cases of other 19 accused soon.
