Erekle Kodua’s Brother-In-Law Was Released from Prison Because of Pregnant Wife

Vladimer Dolidze sues the Georgian judiciary system at the European Court of Human Rights because of his ungrounded imprisonment. He was detained together with Misha Zhorzholiani, brother of the wife of the Head of Criminal Police Department.

Dolidze’s attorney Mamuka Nozadze reported to the News Agency “Pirveli” that his client is in ungrounded imprisonment that contradicts the Article V Part III of the European Convention of Human Rights.

“In accordance to the Article V, everyone arrested or detained shall be brought promptly before a judge or other officer authorized by law to exercise judicial power and shall be entitled to trial within a reasonable time or to release pending trial. Release may be conditioned by guarantees to appear for trial. We requested the release under the bail five times; moreover, the health conditions of Dolidze were grave and we could provide the corresponding medical conclusion on it; however, the judge did not satisfy any of our solicitations. It is noteworthy, that the Court released Misha Zhorzholiani because his wife was pregnant and it is unprecedented fact in the history of judiciary system. As for other detainees – Davit Benidze, Konstantine Chachava and Irakli Ghlonti, they were released because of poor health though, only Dolidze had the medical conclusion about serious problems in liver and stomach. Besides, we offered the most bail – initially 10 000 GEL and then 15 000 GEL while other detainees paid only 5 000 GEL for the release,” said Mamuka Nozadze who said they have already appealed to the Strasbourg Court.

The attorney said, Vladimer Dolidze was “doomed to imprisonment from the very beginning and in fact, he is discriminated because of one more case which was already discussed by the Strasbourg Court and the judgment will be soon announced.”

Nozadze said the second case was about the incident, which occurred several years ago, when Vladimer Dolidze and his father Shalva Dolidze were groundlessly arrested and judged for shooting in Bakhmaro Forest.

“After the Strasbourg Court started discussion of this case, they started oppression on the father and son. The government knows that the European Court will justify the Dolidzes and it does its best to compel the accused to withdraw the suit from the Court. Imprisonment of the son is one of the methods to oppress them,” said Nozadze.

In the middle of April, 2010 the Tbilisi Vake-Saburtalo district police department detained Vladimer Dolidze together with Misha Zhorzholiani - the brother-in-law of Erekle Kodua - the former head of the criminal police department and Davit Benidze, the friend of the former defense minister of Georgia Davit Kezerashvili during the argument in the street. Two more friends – Konstantine Chachava and Irakli Ghlonti were detained for the same incident.
 
They were sentenced to two-month pretrial detention.

The detainees were charged under Article 353 Part II of the Criminal Procedural Code of Georgia (resistance or violence against officer or governmental official) that envisages imprisonment from 4 till 7 years.

The Tbilisi City Court is discussing the case at the moment and the parties are providing the court with evidence.
