Judge Fired from the Appeal Court

Judge Jumber Rosiashvili was fired from the Tbilisi Appeal Court for having passed inadequate judgment on the case.

On March 18, 2009 the Tbilisi Appeal Court discussed Darejan Meparishvili’s suit. The judge prepared a resolution part of the judgment which obliged the administrative institution to reimburse the salary arrears for Darejan Meparishvili. The resolution part was handed to Darejan Meoparishvili several days after the trial and the final judgment was prepared 8 months later. Unlike the resolution part, the judge did not mention the reimbursement of the salary arrears in the final judgment; it was result of the negligence of the judge and not by oppression or interference of the administrative body on the judge. Despite the technical mistake Darejan Meparishvili could not enjoy her right under the Procedural Law – and did not appeal at the higher court. As a result, she agreed with the judgment which was finally put in force,” the press-center of the Supreme Court of Georgia clarified.

According to the provided information, the judge personally wrote resignation letter.

Darejan Meparishvili sued the Penitentiary Department for illegal dismissal of the employee.
