Former Advisor to Former Prime-Minister Zurab Nogaideli Will Spend 17 Years in Prison

Zviad Kharebava - former advisor to the former prime-minister of Georgia Zurab Nogaideli is still in prison. The Appeal Court did not change the verdict of the initial court and Kharebava has to spend 17 years in prison.

Zviad Kharebava was arrested for swindle and peculation but he alleged he was victim of political revenge and 17-year-imprisonment was imposed on him for his denial to denounce Zurab Nogaideli. The brother of the prisoner Grigol Kharebava called the Human Rights Center and requested to publish his letter.

“First of all, I would like to thank to the Human Rights Center for their support and sympathy which we really need now as never before!

I would like to speak about the unjust situation in our everyday life which has become common thing under current governance.

On December 11, 2009, my brother Zviad Kharebava was detained for swindle and peculation and later was sentenced to 17-year-imprisonment for it. It is not necessary to be a lawyer to realize the groundlessness of the swindle accusation. You will not be able to find any signs of swindle in the criminal case materials even though there are testimonies of the witnesses in it who were interrogated under oppression. Participation of my brother in this offense is still secret for everybody who can be interested in it.

As for the second accusation – peculation, I already discussed the mistake of my brother in the previous article published on the humanrights.ge. He made the following mistake: the representatives of the Ministry of Economic Development prepared an acceptance contract based on which the territory with the buildings on it in Martyr Ketevan Ave # 71 in Tbilisi was assigned to the Company “Green Rights Georgia” (Zurab Kharebava was director general of the company which was founded by Kuwait businessman). My brother signed the contract as director general of the company though most part of the buildings did not exist by that time; only ruins remained from another part of the buildings (the air-photos, taken long before the agreement was signed, and expert conclusion prove it). IDPs from Abkhazia lived and still live in the rest part of the building which survived. The accusation was created based on abstract buildings and ruins.

In fact, my brother was arrested because of political activities of Zurab Nogaideli. Several days after his detention, representatives of the prosecutor’s office Zaza Kachibaia and Manuchar Kajaia visited my brother in Gldani Prison # 8. They requested information about corruptive deals of Nogaideli; about his accounts in foreign banks where the former prime minister transferred money earned from corruptive deals. However, I am sure the law enforcement officers already knew that my brother could not have similar information about the prime-minister because he had worked with him only for one and half-year after his arrival from the US. Later, he worked for a private business company. The prosecutor’s office had studied the entire life of Zurab Nogaideli from his birth-date and apparently could not find anything to blame him for. Thus, they had already prepared a testimony (about carbon-credit program in the framework of which my brother had paid 1 million GEL to Zurab Nogaideli). My brother had to sign this testimony. After signature, the prosecutor’s office promised my brother to release him from prison next day and guarantee his security in future.

Of course, my brother did not accept the offer of the the prosecutor’s office and Manuchar Kajaia threatened him with long-term imprisonment and beating with dough-flattener (so-called “false-detector” largely used by Georgian law enforcement officers). Since the detention, they put my brother in the isolation cell for no reason many time and tried to make him obey their nasty orders with similar methods!

I should also mention judges Badri Kochlamazashvili and Giorgi Chemia who exactly executed the orders of the prosecutor’s office and punished innocent people.

For the last one year I have seen how democracy is being built in Georgia in fact!

My brother was detained and punished for political revenge!
