Kakheti Governor Violates Law

Kakheti Governor Giorgi Ghviniashvili has not examined the administrative complaint of Kakheti Information Center. The complaint requests that the individual responsible for issuance of public information issues such information and is imposed with the disciplinary liability for not fulfilling his work obligation.

Kakheti Information Center applied the Kakheti Governor on February 28th of 2011 with the administrative complaint.

“On February 2nd we requested public information regarding the brand and the type of car that Kakheti Governor is served by? Also, we asked for the document that confirms that the administration of the Georgian President passed Toyota Prado to the administration of Kakheti Governor for temporary use. This document has not been provided either. According to the part I of the article 40 of the General Administrative Code, the public department is obligated to instantly issue the information. This public data has not been provided to us. According to the article 41 of the same Code, the refusal on the issuance of the public data should be notified instantly and in 3 days the rights of applicant and the rule of appealing should be explained to the applicant in the written form. Also the structural department or the public body who the refusal on public data issuance was consulted with must be indicated. The defendant has not fulfilled this obligation,” – states the administrative complaint.

According to the article 183 of the General Administrative Code of Georgia, the administrative body is obligated to hear the administrative complaint and make the relevant decision in a month. Kakheti Governor has not examined the administrative complaint and has not informed the plaintiff on it.

According to Kakheti Information Center, this is not the first case when Kakheti Governor Administration does not issue the public information and leaves the administrative complaint unanswered.
