Stricter Punishment for Creation and Funding of Illegal Formations

The stricter punishment for the creation and funding of illegal formations has been already added to the law.

In accordance to the amendments to the Criminal Code of Georgia, creation or leadership of illegal formations (army, union, unit or other group) is punished with imprisonment from 6 to 12 years. Besides, membership of the illegal formation is punished by imprisonment from 3 to 7 years.

Funding of illegal formations – collecting or providing financial sources or other properties for further assistance from the formation is punished by a fine or by imprisonment from 5 to 8 years.

The law clarifies the meaning of illegal formation – army, union, unit or other group. More precisely, similar union is any formation armed with firearms, weapon, explosive or flammable substances, with explosive equipments, teargas, radioactive, nervous-paralytic or poisoning substances, with side-arms or any equipment or subject that can be used for the damage or destruction of live or other objects.

Any person, who voluntarily stops membership of the illegal formation and gives in the abovementioned equipment, if he/she has not committed any other crimes, will be free from criminal liability. The amendments to the law were drafted after the famous events of May 21-26. However, legislators said the strict norms will not work for already committed crimes.
