Kakheti Prosecutor Appointed to the Post of Judge

Kakheti regional prosecutor Tamaz Tsabutashvili is appointed to the post of judge. The President Saakashvili signed the relevant decree on July 4th. Tamaz Tsabutashvili replaced Joni Khetsuriani whose term expired on July 6th.

Joni Khetsuriani was born on November 23rd of 1951. He graduated from Tbilisi State University (1973) and faculty of economics (1988) and is a postgraduate of Institution of Law and Economics of Academy of Scientists of Georgia (1976). In 1976-1989 he worked in the Institution of Law and Economics of Georgian Scientist Academy, as a head of the laboratory, deputy director Research Center of State and Law. In 1982 he was granted a status of youth prize in the sphere of science. In 1977 he defended a candidate degree and in 1944 – PHD. Since 1994 he is a professor of Tbilisi State University. In 2001 he was chosen as a member-correspondent of Georgian Scientist Academy. In 1990-1992 and 1999-2000 ha has been a Minister of Justice. In 1995-1999 and 2000-2001 he worked as a parliamentary secretary of President of Georgia. On July 6th of 2001 he was appointed to the post of member of Constitutional Court by the President of Georgia. In 2001-2006 he was a head of Georgian constitutional court. He has published numerous scientist works, including 6 books on the problems in the sphere of civil, constitutional and criminal law. The first letter regarding the abolishment of death penalty was written in 1979. He took active part in the investigation of the tragedy on April 9th of 1989. He is one of the authors of the Independence Act (1991), Georgian Constitution (1995), Civil Code (1997), and Constitutional Agreement (2002), one of the authors of the projects.

Tamaz Tsabutashvili graduated from the Law Faculty of Tbilisi State University in 1982. Since 2004 he has been a regional prosecutor of Kakheti. Before, during 2003-2004 years he worked in the Office of General Prosecutor and the bodies of the Ministry of Internal Affairs; during 1996-2003 he was a prosecutor of Investigation Department of Kvemo Kartli Regional Prosecutor; during 1995-1996 – prosecutor-criminalist of Criminal Department of Investigation Department of Office of General Prosecutor; in 1994-1995 the investigator of special case department of investigation department of Office of General Prosecutor;

In 1993-1994 he was an investigator of Investigation Department of Special Case of Office of Prosecutor of Republic of Georgia; in 1993 for several months he worked as a chief investigator of Tbilisi interregional Office of Prosecutor; since 1981 to 1993 he worked in the Office of Prosecutor of Tbilisi as a prosecutor of supervision department of transportation legality.

Constitutional Court of Georgia was created in 1996. The plenum of the Constitutional Court decides the constitutionality of constitutional agreement, laws of Georgia, normative acts of Georgia, normative acts of Georgian President, high bodies of autonomic republic of Adjara and Abkhazia, legislative acts of Georgia and the and the resolutions of Georgian Parliament regarding the issues of its adoption, publication, signing and enforcement; discusses referendum, the dispute regarding the issue of constitutionality of international contracts and agreements; gives inference regarding the violations of constitution by Georgian President, the head of the Supreme Court of Georgia, member of Georgian government, Chief Prosecutor of Georgia, the head of Georgia’s Control Chamber and the members of council of Georgian national bank; hears the requests of Common Court. The request to the constitutional court is presented when the court decided that there are sufficient grounds to fully or partially consider the law or other normative act unconstitutional.

The Constitutional Court board hears: the disputes among the state bodies regarding the issues of competence; the issues of creation of political unions and their activity; dispute between the bodies of local government regarding the constitutionality of the elections; the constitutionality of normative acts regarding the issue of article II of the Constitution (Citizenship of Georgia. Basic rights and freedoms); the issue of recognition of authority of Parliament member or ceasing the authority before term.

Georgian Constitutional Court changed its location on July 5th of 2007 and transferred from Tbilisi to Batumi. The Court consists of 9 judges – 9 members of Constitutional Court. The President of Georgia appoints three members of court; no less than 3/5 of the Parliament chooses three member and the rest three are appointed by Supreme Court. The term of authority of member of Constitutional Court is 10 years.
