NGOs Appeal to Khatuna Kalmakhelize

Non-Governmental organizations express their concern regarding the situation in penitentiary institutions throughout Georgia.

The joint statement of the Georgian NGOs states that recent high temperature in summer the conditions of prisoners has worsened significantly, as in most of the rooms there is no ventilation and in some cases prison inmates have problems with water supply. This has created serious problems for those prisoners who serve their term in the so called closed type penitentiary institutions and who have some health problems regarding the heart disease and blood pressure.

The NGO representatives state that the Article 3 of the European Convention on Human Rights prohibits torture, inhuman and degrading treatment.

In accordance to the Standard Minimum Rules for the Treatment of Prisoners, All accommodation provided for the use of prisoners and in particular all sleeping accommodation shall meet all requirements of health, due regard being paid to climatic conditions and particularly to cubic content of air, minimum floor space, lighting, heating and ventilation.

According to the statement, the state has positive obligation to take all necessary measures to create adequate conditions for prisoners and to equip the penitentiary settings with corresponding equipments in order to maintain normal temperature and not to threat the life and health of a prisoner.

Non-Governmental organizations call on to the Ministry of Corrections and Legal Aid to immediately carry out the necessary measures to solve the problem of ventilation in prisons and create human conditions for the prisoners.

The joint statement was signed by the following organizations: “Article 42 of the Constitution”, “Human Rights Center”, “Justice and Freedom”, “Civil Defender”, “Georgian Young Lawyers` Association”, “Former Political Prisoners for Human Rights”, “International Centre on Conflict and Negotiation”, “Network of Caucasus Women”, Union “21st Century”, “Human Rights Priority”, “International Society for Fair Elections and Democracy”, “Research Centre for Elections and Political Technologies”.
