Conditions for Cutting Down Plants Included in Red Data Book to Be Simplified

In order to ensure the security of exploitation of factories and infrastructure, it will be allowed to cut down the trees and plants protected by Red Data Book.

The amendment is planned to be made to the Georgian Law on Red Data List and Red Data Book.

According to the existing norms of legislation, it is allowed to obtain the wild plants or their parts which face annihilation in special circumstances: to restore and multiply them in natural conditions; to grow them in dendrologist and botanical gardens; for agricultural purposes, in order to grow them in artificial conditions; for scientific purposes; if the damage to the wild plants and their parts was caused by the wreckers of plants or plant diseases and their existence creates risk of spreading these wreckers/diseases. Besides, taking them out of the natural environment is the only way to fight wreckers/plant diseases; when constructing special state object or infrastructure. However, in this case the decision must be made by the Ministry of Environmental Protection.

According to the draft law, it will no longer be necessary to cut these trees in cases when they are damaged by wreckers and diseases. But, in general, it will be allowed to cut them “in order to improve the sanitary situation of the forest while sanitary cutting.”

Besides, the construction of special state objects and infrastructure will no longer be a condition for cutting down the trees included in the Red Data Book but they can be cut down in general, while implementing state and public projects.

Except for the changes in the grounds for cutting down the wild plants, new conditions are going to be added to these grounds. Particularly, these kinds of trees can also be cut down if in the territory of agricultural state forest fund, in the zone of traditional use of national park, in certain areas of prohibited and protected territory there are naturally broken-cut ligneous plants. Also, it will be allowed to cut them down for the security purposes while exploitation of factories and infrastructure.
