Request to Re-examine Verdict According to Decision of ECHR Is Limited in Time

An amendment is to be made to the Criminal Procedural Code of Georgia. According to the current formulation of law, the term to re-examine the verdict due to newly revealed circumstances is unlimited in time. The draft law leaves this provision. However, the term to re-examine the case due to newly revealed circumstances by the decision of ECHR (European Court of Human Rights) is limited in time.

According to the draft law, in this case the plaintiff needs to address the court in a year after the ECHR decision takes effect.

Authors and initiators of the draft law are MPs Kakha Anjaparidze and Zviad Kukava. The Parliament has not started to hear the draft law yet.
