Center of Ecology Law Requests Stop of Restriction of Property Rights

Center of Ecology Law held a protest action and a press conference at #26 Agladze St. in Tbilisi along with local residents.

The population is alarmed by unexpected construction works started in the square surrounding Agladze #26 St. and that the city government restricts property rights of residents of apartment building – Tbilisi Supervision Service restricts them to use their own area for commercial purposes.

The lawyer of Center of Ecology Law, Nikoloz Mzhavanadze stated at the action that the construction works started in the square contradict range of legislative acts, including:

1. Tbilisi City Council decision – regarding the stop of privatization of Tbilisi squares, parks, pavements and playgrounds and prohibition to start construction works in these territories. This decision was taken when Mikheil Saakashvili headed the City Council.

2. Decision of Tbilisi City Council on adoption of modalities on usage and greening of territory of city of Tbilisi.

3. Decision of Tbilisi City Council on adoption of general plans for perspective development of the capital.

4. Parliament decree on protection of green zones, parks, bars and squares in the populated areas of Georgia.

5.  Tbilisi City Hall resolution on protection of parks, gardens, squares and green territories in Tbilisi and their perspective widening.

6. Article 37 of Georgian Constitution.

As for restriction of property rights, it violates article 21 of Constitution and property right envisaged by civil legislation of Georgia. (Article 170 of Civil Code of Georgia).

Center of Ecology Law requests Tbilisi City hall to immediately stop restriction of property rights of population and construction works in squares – Nikoloz Mzhavanadze stated.
