Husband Seized Child from a Domestic Violence Victim Woman

25 year old woman Natela Dumbadze, residing in one of the villages in Gurjaani municipality, is a victim of violence. The whole family, a husband, a mother and father in laws, were abusing her. 

“My husband was frequently under the influence of alcohol and we had argument about it very often. During the quarrel he used to beat me in the head. His parents also were abusing me. In November 2014, during this kind of argument, my husband forced me to leave the house. At the beginning, the neighbors sheltered me, and then my parents took me to their house where I live right now. My husband and his parents refused me to take the child,”- said Natela Dumbadze. 

The child of Natela Dumbadze was 1 year and 4 months old when she was forced to leave her husband’s house. The child is now almost 2. According to Dumbadze, the father is not able to take care of the child, because he is unemployed and often gets drunk. As the mother said, her child is in the family were family members are fighting all the time. 

“I want my child to grow up in a peaceful environment, which I think is very important for child’s development. That is why I claim my child back,”- said Natela Dumbadze. 

According to the husband, his wife simulates the facts of beating; he is also against giving the child to the mother. 

“No one can take my child, neither his mother. The child feels fine here,” _ told the husband of Dumbadze to humanrights.ge.

Mother of Natela Dumbadze confirms the fact that her daughter was abused. She says that her son-in-law even beat her when she interfered in their quarrel.  

“My son in law, thanks to his father, is a disabled person. During one of the fights, his father hit a chair to his head and seriously damaged his eye. The grandfather of my son in law, out of jealousy, made her wife put head on the log and cut off her head. My daughter’s mother in law was telling Natela that since she was pretty for what could share the same fate. They were threatening to kill my daughter all the time. My grandchild should not live in such environment,”_ said the mother of Natela Dumbadze while talking to humanrights.ge.

Natela Dumbadze addressed to Gurjaani District Court for divorce. She also claims the child as well as alimony from the father. Lawyer of Kakheti office of Human Rights Centre, Lia Khuroshvili represents her interests at the court. According to Khuroshvili, she appealed to the court on February 23 and the date of hearing is still not set. 

To protect the interests of the child, the Social Service Agency of Gurjaani participates in the case. According to the representative of Social Service Agency Nato Mtivlishvili, the parents of the husband came to the agency and argued with them. The reason of this argument was the restraining order. 

“According to the grandparents of the child I evaluated Natela Dumbadze humanely. They requested to deem Dumbadze as disabled person and say that she is not able to bring up the child. I have been working in the agency for 7 years and have never dealt with similar case before. I have to appeal to the court against them,” said Nato Mtivlishvili.

According to the psychologist Mariam Kviralashvili, not only mother but the child is also a victim of violence: “Emotionality of the child is so tensed, that his situation is very serious. In all cases the advantage is given to the mother, if she is able to take care of the child”.

The case of Natela Dumbadze is not the only case of violence against women, which is covered by humanrights.ge. The statistics revealed 1 104 facts of domestic violence in 2007-2014. 1 010 of victims were women.
