Human Rights Center Calls on the Vake-Saburtalo District Prosecutor’s Office to Timely Return Car to Giorgi Gudadze

Giorgi Gudadze applied to Human Rights Center for legal assistance.

First division of Vake-Saburtalo department of the Tbilisi Main Department of the Ministry of Internal Affairs is investigating case №007170215009 about premeditated injury of Giorgi Gudadze’s health.

During the investigation, police took his car Porsche Cayenne (state number JZZ 778) as evidence, which was damaged during the incident in February 2015.

Giorgi Gudadze’s car has been in the police station since February 2015 as evidence. Consequently, the owner of the car has been deprived of the right to use his property for unreasonably long period of time.

We acknowledge that the investigation needs the car to estimate concrete factual circumstances in the case, but it should also be taken into account that investigation into the case shall be carried out timely and effectively and the property shall be returned to the owner within the reasonable period of time.

Argument of the Vake-Saburtalo district prosecutor’s office that they might need the car for the solution of the crime and estimation of the offender is not well grounded. It is noteworthy that the investigation has been underway for eight months and the prosecutor’s office has not taken effective measures to return the car to the owner and effectively investigate the case.

Based on the aforementioned circumstances

Human Rights Center calls on 

 The Vake-Saburtalo district prosecutor’s office to return the car to its owner Giorgi Gudadze within the reasonable time in order to ensure his right on the property.
