Address of Human Rights Center to the Parliament of Georgia about Recent Developments about Aleko Elisashvili’s Statements

Human Rights Center is concerned with the fact that chairwoman of the Human Rights Committee at the Parliament of Georgia Eka Beselia is still a member in the Prosecutors Council that raises serious questions about effectiveness and impartiality of the investigation into the alleged oppression facts against former chairman of the Pardon Commission Aleko Elisashvili. 

As main purpose of the Prosecutors Council is to ensure independence and transparency of the Prosecutor’s Office of Georgia and to promote effective implementation of the prosecutor’s office’s functions, membership of MP Eka Beselia in the Council creates serious threats of influence over the Chief Prosecutor’s Office to conduct impartial probe into the alleged oppression facts.

The Prosecutor’s Office is investigating alleged oppression on Aleksandre Elisashvili from the side of the chairwoman of the Human Rights Committee at the Parliament. At the same time Eka Beselia is still member of the Prosecutors Council and the Parliament of Georgia does not react on that. The society has legitimate doubts that the Government of Georgia is not willing to estimate real truth in the case and at the same time supports the MP.

At the same time, it is noteworthy that the Parliament of Georgia inadequately analyzes its responsibility to promote impartial and transparent investigation into the case and does not react on the interest conflict of the Human Rights Committee’s chairwoman.

In accordance to the Article 55 of the Rules of Procedures of the Parliament of Georgia, the Parliament can create Temporary Investigative Commission based on the following information:

  A state agency, or a government official committed unlawful action, corruption act that create threat to the state security, sovereignty, territorial integrity, political, economic or other interests of the state;
 and it is particularly significant for the state and society to investigate the unlawful action.

Human Rights Center believes that when the former chairman of the Pardon Commission blames the senior MPs at the Parliament of Georgia Manana Kobakhidze and Eka Beselia of oppression and there is high public interest into the case, the Parliament of Georgia shall create temporary investigative commission to study alleged unlawful actions of the senior officials. At the same time, to ensure impartiality of the investigation, the Parliament shall suspend authority of the chairwoman of the Human Rights Committee and Deputy Speaker of the Parliament before final decision is made about the case.

Human Rights Center appeals to the Parliament of Georgia 

To make decision on suspending the membership of MP Eka Beselia in the Prosecutors Council;

To create temporary investigative parliamentary commission to study alleged unlawful actions of MP Eka Beselia and MP Manana Kobakhidze;

To suspend authorities of the chairwoman of the Human Rights Committee Eka Beselia and the Deputy Speaker of the Parliament Manana Kobakhidze before the Commission makes final decision with regard to the allegation.
