Public Defender Appeals to High Council of Justice with Recommendation

The Public Defender has appealed to the High Council of Justice with a recommendation to ensure unimpeded consideration of civil and administrative cases in Tbilisi City Court.  

The cases studied by the Public Defender's Office show that there are delays in the consideration of civil and administrative disputes by Tbilisi City Court.

Systemic problem of violation of the terms defined by law in the courts of Georgia is also proved by  the report on disciplinary cases issued by the High Council of Justice in 2014, according to which, delays in the consideration of cases hover between one month to three years and is largely conditioned by the lack of judges.

The violation of the terms defined by law represents a violation of the right to a fair trial.

The Public Defender demands the High Council of Justice to examine the mentioned issue and take effective measures in the shortest period to ensure consideration of civil and administrative cases within a reasonable time, including through definition and appointment of sufficient number of judges in Tbilisi City Court.
