The Court Satisfied Appeal of Human Rights Center

On March 30, 2016 the Gori district court satisfied the claim of Mzia Okruashvili and ordered her to pay 240 GEL instead 960 GEL for the leased trading booth. Lawyer of Human Rights Center’s Gori office Eliza Kerdikoshvili represented Mzia Okruashvili at the Court.

On May 31, 2013 Mzia Okruashvili signed a lease agreement with the Gori City Hall, based on which she leased a trading booth in the public bus-stop. Okruashvili operated a small shop in the booth and according to the contract; she had to pay 40 GEL as a rent to the City Hall.

Okruashvili stopped trading in the booth on December 5, 2013 and notified the Gori City Hall about it 6 months after signing the lease contract; she requested to cease the contract. In its reply to Okruashvili, the Gori City Hall asked her to find a new leaser, otherwise they refused to cease the contract. The City Hall’s letter was dated by February 19, 2014 but Mzia Okruashvili received it in June, 2015. 

Gori City Hall appealed the Court to demand Mzia Okruashvili to pay lease payment for two years that was 960 GEL.

The lawyer of Human Rights Center said Mzia Okruashvili did not have obligation to present a new leaser based on their agreement. Considering that, the City Hall had to cease the contract after the citizen notified them about stopping trading activities in the booth. The Gori district court satisfied the claim of Human Rights Center.
