Address of Human Rights Center with regard to the activities of former director of medical clinic Lancet Farman Jeyranli

Human Rights Center echoes the recently disseminated evaluation statements about Farman Jeyranli’s activities as a former director of the medical clinic Lancet by different media sources. Several days ago, TV-Company Rustavi 2 dedicated a video-story to his case in its weekly program P.S.

Farman Jeyranli, his advocate and friends claim that he was persecuted by the Azerbaijani authority and his arrest was result of secret cooperation between Azerbaijani and Georgian authorities. Journalists often associate his arrest with the kidnapping and arrest of the Azerbaijani journalist Afgan Mukhtarli in Tbilisi. 

Human Rights Center does not share allegation that Farman Jeiranli is innocent in the concrete criminal case, which was launched against him in connect with his activities in the medical clinic Lancet and does not agree that his imprisonment has political motives.

Georgian prosecutor’s office arrested Farman Jeyranli, director of the Ltd Lancet based on the judgment of the Tbilisi City Court for the crimes punishable under the Article 180 Part III and Article 247 Part I of the Criminal Code of Georgia - concealment or falsification of information concerning the circumstance, fact or event hazardous for human life, health or environment that has been committed by a person obliged to provide this information to the public. Before that, the State Regulation Agency for Medical Activities forbade the Lancet to carry out transplantation operations of organs. The Tbilisi City Court found the director of the medical clinic guilty and sentenced him to 6-year imprisonment.

Human Rights Center thinks that considering the current political situation in Azerbaijan, it is not excluded that the Azerbaijani authoritarian government really persecutes Farman Jeyranli but it does not free him from the responsibility for the crimes he committed in Georgia.

Human Rights Center Nestan defends interests of the families of the deceased patients of the medical clinic Lancet – Giorgi Chubinidze and Karlo Kekelidze. The medical treatment of the patients from the moment they arrived at the clinic till their death and the entire history of medical manipulations were conducted through total negligence of the legislation; it is proved by the State Regulation Agency of Medical Activities. The liver transplantation operation was conducted in the clinic without respective license, which was to be issued by the Transplantation Council in accordance to the Article 18 “g” of the Law of Georgia on Transplantation of Organs that is violation of the Law of Georgia about Healthcare, Article 53 Part 3. The operation was conducted by the doctors, who did not hold certificate issued by the Georgian state authorities that contradicts the requirements of the Article 11, Part 5 of the Law of Georgia about Medical Activities.

When investigating the causes of the patients’ death, many violations and miscarriages were observed in the activities of the medical clinic. On that ground, it is impossible to discharge the director of the clinic from responsibility. At the same time, other decision-maker persons and doctors (including the chief doctor), who participated in the management of the clinic, shall also be held responsible for the activities or inactivity, which resulted into the death of patients. 

Although Farman Jeyranli did not personally participate in the illegal operation, he as a director of the medical clinic is fully responsible for the violations or crimes committed in his clinic. The director was responsible to receive and analyze the full information about the qualifications of the doctors, who carried out surgical operations in his clinic.

Human Rights Center was initiator to establish the South Caucasus Network of Human Rights Defenders and in the frame of different projects HRC defended rights of Azerbaijani citizens who were persecuted in their country; HRC represented them in front of administrative bodies of Georgia, in the courts and international institutions.

Consequently,  it is not difficult for Human Rights Center to support and defend any citizen persecuted in Azerbaijan if he/she is innocent and the state violates his/her rights without any grounds. In case of Farman Jeyranli, it is not the case. His guiltiness is evident and HRC believes he shall be punished in accordance to the Georgian legislation regardless the fact he is persecuted by Azerbiajani authority or not.
