Judge annulled the penalty imposed by a patrol police officer

On February 20, Judge Davit Papuashvili at the Gori District Court annulled the 50 GEL penalty of Giorgi Aniashvili, which was imposed on him by patrol police officers.

Patrol police officers fined Giorgi Aniashvili on January 27, 2019. The police argued that Aniashvili was driving through a red light. Aniashvili considered the penalty illegal and appealed the court. HRC Shida Kartli office lawyer Aleksi Merebashvili defended his interests in the court. 

“We requested interrogation of the police officers, who fined Giorgi Aniashvili in the street. During the interrogation both officers confirmed that they had not seen the driver driving through a red light and sanctioned him only based on assumption. Their clarifications contradicted the video-recordings provided by the Ministry of Internal Affairs. Consequently, the judge fully shared our position and annulled the penalty; consequently, administrative proceeding against the client was dropped,” the HRC lawyer said. 

On January 27 Giorgi Aniashvili protested the penalty and stated that police officers treated him rudely. The incident ended up with his administrative detention in accordance to the Article 173 of the Administrative Code of Georgia, which refers to the disobedience to lawful requests of law enforcement officers.
