Thanks to the aid by HRC, a citizen shall no longer have to pay a fine of GEL 3,000

HRC successfully completed another case of administrative proceedings concerning a citizen who was unjustly fined by the state during the spread of the pandemic.
 
Citizen V.T. applied to HRC for a legal aid. On April 3, 2020, the police drew against him a report of administrative offense based on which V.T. was fined with GEL 3,000 for violating the requirements of the state of emergency. According to the assessment made by HRC, the violation of the requirements of the state of emergency by V.T. in particular the violation of the curfew, was caused by an urgent necessity related to the health of a minor child. 

Through the involvement of a lawyer from HRC, the report of administrative offense was appealed to the administrative authority. Since HRC did not receive the response on the complaint lodged with the authority within the timeframe established by the law, the lawyer filed an administrative complaint with the Magistrate Court of Kaspi. 

The court heard the case on September 28. On the court hearing, a lawyer of the Ministry of Internal Affairs submitted a decision adopted by the Police Department of Shida Kartli from September 16 granting the administrative complaint of the lawyer of HRC.  In accordance with the decision by the Police Department, the administrative complaint of V.T. was granted in full and the citation issued for the fine of GEL 3000 was deleted. 

The successful completion of the proceedings by HRC was possible within the frames of the project Democracy and Human Rights during the State of Emergency supported by Open Society Foundation. The project is implemented by three partner organizations: ISFED, GDI and HRC.
