Special Penitentiary Service Was Ordered to Pay 50 000 GEL to the Victim of Torture

The Supreme Court of Georgia upheld the decision of the Tbilisi Appellate Court of July 24, 2024, which ordered the Special Penitentiary Service to pay 50 000 GEL to a citizen in relation with the case of torture, inhuman and degrading treatment in the penitentiary establishment in Georgia. 

L.K was victim of torture and inhuman treatment in the penitentiary establishment No 8 during many years, which significantly damaged his health. In 2017, L.K. received victim status based on the order of the prosecutor. 

Human Rights Center appealed the court with regard to the case of L.K. on July 1, 2020 and requested compensation for moral damage. On November 15, 2022, the Tbilisi City Court announced the decision and satisfied the appeal of the Center; the Court ordered the Special Penitentiary Service to pay 30 000 GEL to the applicant. Both parties appealed the decision in the Tbilisi Appellate Court. 

In accordance with the guilty verdict of November 12, 2019 in the case of L.K, senior officials and employees of the Penitentiary Establishment No 8 were convicted for the crimes punishable under the Article 1441 Part II – a, d, e, g of the Criminal Code of Georgia (torture, i.e. exposing a person to such conditions of treating him/her in a manner that causes severe physical pain or psychological or moral anguish and which aims to obtain information, threaten or coerce, or punish the person committed by an official or a person holding equivalent position by abusing official position by a group of persons against a person arrested or otherwise deprived of freedom).   

In October 2024 the case was forwarded to the National Enforcement Bureau. 

Court Ordered European School to Pay 25 000 GEL to the Teacher 

On October 30, 2024, the Tbilisi City Court announced the decision, with which it partly granted the appeal of the Union of HRDs – Human Rights Center. As a result, the European School was ordered to pay 25 000 GEO to T.B. The order on the dismissal of the teacher was annulled and the European School was ordered to reimburse her salaries of missed months. The Court did not grant the discrimination part of the appeal. Lawyer of the Union of Human Rights Defenders – Human Rights Center represents T.B in the court. 

Ltd Embawood Shall Pay 10 000 GEL to Former Employee

In September 2024, the Tbilisi City Court fully granted the lawsuit of the lawyer of the Union of HRDs – Human Rights Center, annulled the dismissal order against G.G., who had worked in the company factory for more than 10 years; the Court ordered the Ltd Embawood to pay 10 000 GEL to G.G. as a compensation. 

Court Ordered the IDPs, Eco-Migrants and Livelihood Agency to Pay 67 000 GEL to Unlawfully Dismissed Employee 

The Tbilisi Appellate Court upheld the decision of the Tbilisi City Court, which granted the lawsuit of the Union of HRDs – Human Rights Center and annulled the order of the LEPL IDPs, Eco-Migrants and Livelihood Agency of the Ministry of IDPs from the Occupied Territories, Labor, Healthcare and Social Welfare of Georgia to dismiss O.S. from working place. The Courts ordered the Agency to pay compensation to O.S. and reimburse the salaries of the missed months in the amount of 67 000 GEL. 

The Court Annulled the Ticket of the Patrol Police 

On July 18, 2024, the Gori District Court partly granted the administrative lawsuit of A.B, and annulled the 2 000 GEL ticket of the patrol police issued against him as well as the decision to suspend his driving license for three years. The refusal of the patrol police department to satisfy the administrative complaint of A.B. was also annulled. The Patrol Police Department was ordered to re-consider the complaint and issue new decision.

The Court Decided to Satisfy IDP Family with Long-Term Accommodation 

On August 19, 2024, the Tbilisi City Court fully granted the administrative lawsuit of the IDP T.G. The order of the director of the LEPL IDPs, Eco-Migrants and Livelihood Agency to refuse family of IDP T.G. to satisfy with the long-term accommodation and ordered the LEPL to issue a new act, based on which the IDP family will receive the accommodation.

The Court Annulled the Order of the Gori Municipality Mayor to Fine a Citizen without Evidence 

On October 3, 2024, the Gori District Court fully granted the administrative lawsuit of N.K, and annulled the July 31, 2024, order of the Gori Municipality Mayor. Based on the disputed order, N.K was fined with 4 000 GEL for allegedly unlawful construction without any evidence.

LEPL IDPs, Eco-Migrants and Livelihood Agency Was Ordered to Re-Consider the Case of IDP Family 

On October 8, 2024, the Tbilisi Appellate Court partly granted the appellate lawsuit of T.L, an IDP from Tskhinvali and annulled the decision of the Tbilisi City Court. In accordance with the decision of the Appellate Court, the order of the Agency’s director to refuse IDP T.L. to satisfy his family with the long-term accommodation was annulled. The Court held that the Agency had not examined significant circumstances of the case and ordered the Agency to re-consider them and issue a new act with regard to T.L’s application.
