Sulkhan Molashvili Still Illegal Prisoner

Legal proceeding against ex-chairmen of the Chamber of Control, Sulkhan Molashvili was held on August 5, 2005. Teimuraz Nemsadze, the new advocate of Molashvili demanded 30 days for the studying the case, envisaged by the law. However, judge, Manuchar Kapanadze, didn’t satisfy his demands and granted him only 5 days to get familiar with the case. According to the court decision, the next discussion of Molashvili case is scheduled on Thursday. The attorney of Molashvili is going to appeal against the decision of the judge.

Ex-chairman of the Chamber of Control was arrested in April last year. He is charged with abuse of power and with making financial damage for the state budget. According to the current legislation, a person can be in pre-detention imprisonment maximum for 9 months, but Sulkhan Molashvili is imprisoned for 16 months being an illegal prisoner already for 7 months.

At 12 o’clock on August 5 this year, court discussion of Sulkhan Molashvili was renewed, but process ended without results. Both advocates of Sulkhan Molashvili, Shalva Shavgulidze and Soso Baratashvili had gone on a vacation. Taimuraz Nemsadze was changing them on a process. The new attorney of Molashvili demanded 30 days to study the case in detailed. This period is envisaged by the article 429(2) of Criminal Procedure Code of Georgia. Judge didn’t satisfy his demand and granted him only with 5 days. It should be significant that the case of Molashvili consists of 25 volumes with 500 pages each. Athough, Teimuraz Nemsadze stated that he is not able in such a short period study the case, the judge didn’t change his decision.  

Prosecutor Manana Musulishvili identified the mentioned demand as only the reason for on purpose prolongation of the court process. She thinks that advocates of Molashvili specially organized this fact in order to prolong the court proceedings. “There is everything to prove his guilt that’s why they want to prolong the time”-stated the prosecutor.

The ex-chairmen of the Chamber of Control Sulxan Molashvili is amazed with the above mentioned accusation of Manana Musulishvili. He has been waiting for starting the court discussion since December and it has been prolonged till July and now when he, in the framework of the law, demands extra time, he is denied to satisfy his demand and at the same time is blamed in special prolongation of court proceeding. “Even animals are not treated like this”- stated Molashvili filled with aggravation and added that if situation continues like that he will refuse to have defense and will hand his faith in the hands of the judge and the prosecutor.

The advocate of Sulkhan Molashvili, Teimuraz Nemsadze stated that judge was under presser. The attorney couldn’t hide frustration towards the court decision and stated that judge is suppressing the rights of defense side and with violation of all laws refuses to satisfy his demands. Teumiraz Nemsadze is going to appeal against the court decision.
