The Prisoner will Face the Life Imprisonments In Case of Extradition 
 

Azeri prosecutor is demanding the extradition of Azer Ramiz Ighli Samedov. NGOs, which are protecting the human rights, are protesting it, because he will face the political imprisonment there. NGOs and lawyers remind the government about the European Convention on human rights , according to which if the person’s life is in danger, his extradition is not allowed.

The representatives of antiterrorists department at MIA (Ministry of Internal Affairs) arrested the member DEVAMM - Azer Ramiz Ighli Samedov on March 26.  April 2, 2006 the court gave him 3 months pretrial detachment. Azeri prosecutor is blaming him according to the 220 and 315 clauses, which means the support of the mass disorder. He is blamed for organizing disorder after 2003 presidential election. Another representative of DEVAMM- Aldjan Huseinov, was arrested with him. He was released after 4 hours because they could not prove his participation in this wrongdoing.

DEVAMM got the information about his arrest from “Caucasus Institute”. The representative of DEVAMM and general secretary of international organization “The freedom of the religion” Elgar Ibragim Obghlu considers the arrest fact illegal and human rights violation. “He did not participate in the disorder of 2003 October 15 – 16. He simply made a monitoring about the human rights violation during the election period. It is the violation of freedom of speech and fight against human rights protection.”

Elgar Ibragim Obghlu asks the Georgian government to release the prisoner and stop the violations, which is guaranteed according to European Convention. He also addressed the international and local organizations.

The representative of “Caucasus Institute” Emil Adelkhanov reacted on the Samedov arrest fact. As he mentioned it with the “Human Rights Information & Documentation Center” “Azeri prosecutor asked Georgian government to arrest that person. They had had the information that he was in Georgia. Azeri prosecutor does not have evidence for the allegations against him. If we do not react on this fact, he will be sent in Azerbaijan, where he is likely to face the political imprisonment. It is the violation of human rights and we are protesting it. Georgia signed the international convention of human rights, according to which, the prisoners like Samedov should not be extradited.”

Dato Managadze - the lawyer of “Human Rights Information & Documentation Center” consider the arrest of Samedovi illegal and human rights violation. “In case the prisoners extradition, will end up with his death or he is traced by political or religion reasons it should not be done. If the crime is committed here in Georgia, he should be judged here, and even it is committed in Azerbaijan, he should be judged according to our law. According to European Convention of Human Rights the extradition should not be done, if the person is traced because of his different views.”

The relatives of Samedovi are here in Tbilisi, and they are demanding the release of the prisoner. They gathered in front of the Ministry of Internal Affairs, but could not enter or meet anybody there. Azer Samedovi is a political prisoner, and in case of extradition he will face life imprisonment. As they say Samedovi did not participate in the protest actions and disorder.

Neither prosecutor nor MIA is making a comment on it. They say that they will take legal decision.
