Cars, ran away from Georgia are legislated in Armenia


Armenia does not implement the International and double Settlements

Albert Kakablishvili, Georgian citizen, has been asking his car back from Armenian Force offices for five years, though without any result. Georgian colleagues of Ministry of Interior Affairs also applied to Armenia Prosecutor Office for returning the car back to its owner, but they refuse to implement the International settlement.

Incurred Kakablishvili’s car “ford-transit” with state number GRG321 was run away from Varketili distr. Tbilisi on the 10th of November in 2001. He appealed to Isani-Samgori regional police department and after that the case was lunched. The preliminary investigation proved that kakablishvilim was really robbed and his car was run. The investigation estimated after a long-term work, that elaborated car was moving in Armenian Republic. Its owner was certain Karen Senokiani, living in Erevan. He was working on the ninth rout line by this car in Erevan.

Law-enforcers estimated that the car was transported from Tbilisi to Aremenia by Arkadi Sarkisov, living in Varketili, and sold it to a certain S. Atoian by the technical passport, issued by the Traffic Police of South Ossation Interior Ministry. Atoian sold this car to Karen Senokian for 8000USD.

After receiving the information, the judge from Isani-Samgori district, Feikrishvili made a decision on the 11th of August 2004, confiscating up-mentioned car from Senokia and returning it to its real owner. Despite several appeals from Georgian side, Armenia ignores these requests and do not plan to hand the cars.

It is important to admit that Georgia as well as Armenia has signed various international and double settlements about mutual cooperation. Among these documents are: Minsk agreement about legal assistance between CIS, Armenia-Georgian treaty about mutual assistance and European Convention.

According to the victim, he has even traveled to Yerevan, though without any result. “I’ve been to Yerevan and have personally submitted appeal in the Court, with the whole information collected from investigation by Georgian side. The hearing of the case is still delaying. Armenian side ignored my appeal. I’ve seen my car in the streets of Yerevan. His owner told me – pay 8 thousand US dollars and I will give you the car”.

Despite the fact, that the victim asked different bodies for help, he is not able to return his car. The letters were sent to the Ministry of Internal Affairs, General Prosecutor’s Office, to the Head of Parliamentary Committee of International Affairs, Special Operation Department of the Ministry of Internal Affairs, to the Ministers of Justice in Georgia and in Armenia. According to the victim, he has received general, useful answers from them.

David Managadze, the lawyer of the Human Rights Information and Documentation Centre is defending Kakablishvili. “General Prosecutor’s Office of Georgia and Isani-Samgori regional Courts have send the letters to their Armenian colleagues. They checked the address, pointed in the documents. It occurred, that person, who have crossed Georgia-Armenian border with the car, has gone to Russia. However, neither Georgian, nor Armenian authorities have launched search of the very person, who has crossed the boarder with the stolen car, without documents. I think someone is protecting the thief.”

Shalva Ogbaidze, the head of Transport Federation of Georgia confirms that such cases often take place in Georgia. “Cars, stolen from Georgia, often are sold in Armenia and Azerbaijan. One famous Armenian judge is legalizing stolen cars. I can not remember the exact name, however he is known as a protector of the stolen vehicles”.

According to the lawyer Managadze it is impossible to return the car, because Georgian side does not want to spoil relationship with Armenian colleagues. Managadze thinks that Georgian investigators should have travel to Armenia for better studying of the case. The only way out is that Georgian Government reimburses losses to Albert Kakablishvili. “According to Criminal Processing Code of Georgia, the side where the criminal took place is responsible of reimbursing the losses. However, it needs Court Resolution. Theoretically, it is possible”.
