“My Final Hope Is Strasbourg Court” Bath House Battles Ministry of Defense

Kukuri Iremadze, former lease-holder of the Batumi Central bath-house, has to receive money from the Defense Ministry and a former state owned company “Adjarkopservisi”. Although the court made the decision five years ago, Iremadze has not been paid yet.  

Iremadze received the final answer from the Execution Department of the Ministry of Justice on June 2 2008. “Execution Department of the Ministry of Justice discussed your appeal that was submitted to our Ministry from the Georgian Prosecutor General’s Office. Special team for execution particularly important cases within the department is discussing your appeal and currently the execution must be implemented by force,” said Avtandil Kenchadze, the head of the Western Georgia’s Execution Department.

In 2002 the reply from colonel Chigogidze (financials-budget committee) stated: “We kindly inform you that based on the decision that was passed by the Tbilisi Vake-Saburtalo District Court the Defense Ministry was required to pay 43, 908 GEL to your bath-house for the implemented service. However, because of lack of budgetary funds we are unable to pay the debt.”

“According to the 2003 Georgian Law on State Budget, a fund for the execution of court orders was established in the central budget. The above-mentioned court decision will be paid out from that fund.”

Kukuri Iremadze inquires: “I understand that but so many years have passed since that decision was passed but there are no changes. I demand my money, nothing more.”

The Georgian Defense Ministry accumulated the debt of 43,908 GEL to Iremadze for the provided service for the military unites dislocated in Batumi. Iremadze stated that he had implemented the agreement that he had signed in agreement with the Defense Ministry. However, his service has not been reimbursed yet. Consequently, Iremadze then appealed to the court.

Iremadze leased the Batumi Central Bath House in 1994. Then the enterprise belonged to State Company “Adjarkopservisi”. Iremadze opened other small enterprises in the basement of the bath-house and he signed a separate lease-contract. “I spent 20,000 GEL repairing the basement. Thus, we wrote in the contract that if the agreement was annulled the owner of the property had to return the money (20,000 GEL) back. However, I have not received that money either.”

In exchange of 20,000 GEL, Iuri Kiladze, the head of the State Company “Adjarkopservisi” and Kukuri Iremadze signed a protocol to the agreement. According to the protocol two rooms in the basement of the Bath-House was assigned to Iremadze as private property. Initially the protocol was confirmed by the court; Iremadze then registered the space but another lease-holder of the same space, Durmishkhan Khinikadze, the head of the “Litonkopsheketeba ltd”, appealed to the court against the protocol and it was annulled on November 8 2004. Iremadze then lost the property.”

“Let’s say that they did not assign the property to me but they still owe 20,000 GEL to me. Who will give me the debt? The “Adjarkopservisi” does not exist anymore. The territory has new owner… I hoped the government would change and the justice will celebrate in the country but I was discouraged by the results of the elections. My last hope is Strasbourg,” said Iremadze.

Building Company “Arsi” is building a multi-functional complex on the place of the Central bath-House in Mazniashvili Street; the complex will be completed in September of 2008.

Kukuri Iremadze intends to continue his legal argument before the court but this time he will take the final appeal to Strasbourg.
