Teacher Blames Director for Labor Trafficking

Eka Jandieri, a resident of Telavi, blames Nino Vakelishvili, director of Telavi Public School # 5, for labor trafficking. Jandieri claims that she has worked at school for one year without any salary. Besides that, deputy director made her to look after her little grandchild and ordered to do various jobs at school.

“Initially I started working as a teacher seeking for permanent position at school. But on September 17, 2007, based on the resolution, school director appointed me as a substitute teacher (if any teacher missed lessons she had to conduct lesson instead of him/her). I worked on this position for one year but did not receive salary. Whenever I asked the director for salary she used to get very irritated at me; she was shouting and insulting me. Consequently, I applied to the Education Resource Center of Telavi district for help but they did not pay attention to me either. The director destroyed her resolution on my appointment as a substitute teacher according to which I had to take a salary. The director tried to threaten me with police too,” said Eka Jandieri.

Eka Jandieri applied to the administration of Kakheti regional governor and Ministry of Education; but, in vain. Irakli Todua, interim head of the regional coordination department of the Ministry of Education, replied to Jandieri that disagreement between the parties of a labor agreement should be settled at the court. Administration of Kakheti regional governor sent her appeal to Tinatin Javakhishvili, the head of Telavi District Education Resource Center, for further discussion. “We kindly request you to consider the attached appeal of Eka Jandieri and report the applicant and administration of Kakheti Regional Governor about your decision,” states the letter of the regional administration. However, Javakhishvili sent the letter to the director of Telavi Public School # 5. The resource center reported to the applicant and the regional administration that there is no vacancy of the teacher of Georgian Literature at Public School #5; thus the applicant could not be employed. It must be noted that Eka Jandieri in her appeal to the Kakheti regional administration and Telavi district education resource center requested to react on the facts she had mentioned in her appeal.

Nino Vakelishvili, director of Telavi district Public School # 5 denies the accusations of the teacher.  She claims that Jandieri worked as a teacher seeking for permanent position and her activities cannot be reimbursed based on the law. Vakelishvili does not confirm the fact that Jandieri worked as a substitute teacher at her school.”

“According to the Law on General Education, a teacher seeking for permanent position enjoys all rights and privileges envisaged under the law except salary reimbursement and participation in the elections of Board of Trustees. Consequently, Jandieri enjoyed the medical insurance within state program for teachers.“

-Ms. Nino, Ekaterine Jandieri holds the resolution you have issued in March of 2008 which states that she worked at Telavi Public School # 5 as a teacher. According to the Ministry of Education if Jandieri worked as a teacher seeking for permanent position by that time, director should not have issued similar resolution on her.

-She did not work as a substitute teacher at our school; she was seeking for permanent position, attended lessons and sometimes had right to conduct them too. It does not mean that Jandieri was a teacher at our school. As for the resolution you are speaking about, and you claim that I have signed it, I do not remember concrete details in it,” said the school director.

Eka Jandieri intends to take her salary through appealing to the court. She has already submitted administrative suit to the Ministry of Education and after receiving the reply from the ministry she will appeal to Telavi District Court.
