There Are People in Georgia Who Get a Pension of 2, 50 GEL

50-year-old Bezhan Baduashvili is a disabled person of the second grade, but because of strange interests he turned up in the third grade of disability. Consequently, on September 1, 2007 and in accordance with the Law on Granting Pensions to Military Servants, he lost his pension which was granted in 2002. Since then, his pension is only 9, 07 GEL. The Ministry of Healthcare explained this fact in their letter to Bezhan Baduashvili as follows: “Because the Law of Georgia on State Compensations and Academic Scholarships, adopted on December 27, 2005 and put in force on January 1, 2006, does not envisage continuation or appointment state compensations to the people who have some abilities.” 

It clarifies everything but one circumstance – in 2005 the diagnosis of the first medical examination on Bezhan Baduashvili states that he has closed trauma on his skull, he has moderate hypertension, encephalopathy, chronic vertebra-basilar insufficiency,   exposed vestibular misbalance, osteochondritis, arthritis of both ankles, astheno-depressive syndrome, cholecyst, angiopathy, disability to hear. For all these reasons he was dismissed from work.

Bezhan Baduashvili worked at the ministry of internal affairs for 26 years. Based on his diagnosis, he belonged to the second grade of disabilities and received 105 GEL as a pension. In 2007, the same diagnosis was not enough to get pension. The disabled person of the second group was transferred into the third grade.

In 2008, Bezhan Baduashvili applied to the former public defender Sozar Subari for help. Subari appealed to the minister of healthcare Aleksandre Kvitashvili because in this particular case the right to minimal living source was restricted as well as guarantee on state compensation. Subari recommended to the Minister to introduce adequate amendments to the instruction on “identifying the status of disability” which could support complete realization of the right on social protection.  The Ministry took the recommendation into consideration but it did not have any impact on Baduashvili’s pension.

Bezhan Baduashvili petitioned to the Ministry on January 13, 2010. He was asked to get in touch with the ministry for further reactions but nobody wished to meet him. The officials told him: “You can sue us wherever you want.”

At one event the minister Aleksandre Kvitashvili evaluated the case of Bezhan Baduashvili as obvious violation but nothing has done to solve his problem yet.

Beszhan Baduashvili was moved to the third group of disability on purpose in order to reduce the pension and not based on his diagnosis. Otherwise, he could work. Consequently, he calls the people, who illegally reduced his pension, robbers.

Baduashvili said he is not the only person in this situation. There are people who get pension of 2, 50 GEL. He has not had electricity supply for one month already because he could not pay the bill.
