Illegal Prisoner has Been Released

On June 10, the lawyers of the NGO “42nd Article of the Constitution” demanded from the prison authority to release the illegal prisoner, a 64 year-old Nanuli Kenkadze, who terms of detention expired on June 9. Neither investigator nor the prison administration has applied to the court for prolonging the terms of imprisonment for the prisoner. The prison administration was responsible for informing the relevant body dealing with the issue about the dates. Nanuli Kinkadze was an illegal detainee since June 9, 2005. The lawyers of the detainee demanded the prevention of the illegal detention. This fact was a surprise even for the detainee.

Nanuli Kenkadxe was blamed in Trafficking according to the article 143 of the criminal code of Georgia that envisages the deprivation of the liberty from 8 to 15 years. 64 year-old convict was in poor health situation in prison. The attorneys consider that she should have been subjected to the article 172 of the Criminal Code of Georgia (illegal dealing towards the infant for the purpose of adoption) that does not envisage the deprivation of the liberty at all.
