Judge Nino Bakakuri satisfied appeal of Lasha Chkhartishvili, Jaba Jishkhariani and other members of the 'Egalitarian Institute' and found the verdict passed by the Administrative Board within Tbilisi Civil Court illegal.
The case dealt with the appeal of the 'Egalitarian Institute' against the bailiff working at the Tbilisi Civil Court and Main Department of Patrol Police within the Georgian Interior Ministry. Lasha Chkhartishvili and other members of the institute were defended by 'Article 42 of the Constitution" with Manana Kobakhidze as a Chairwoman and by Koba Bochorishvili, representative of the ' Centre for Constitutional Rights '. The lawyers demanded moral reimbursement of 10 000 GEL for dispersing the members and supporters of the 'Egalitarian Institute' during the demonstration. They were dispersed by the bailiffs. They also demanded to found the Patrol Police's inactivity illegal; they did not protect peaceful participants of the demonstration.
On August 30, 2006 Administrative Board of the Tbilisi Civil Court refused to discuss the case. This refusal was sued by the lawyers Manana Kobakhidze and Koba Bochorishvili. They stated that aforementioned decision made by the Tbilisi Civil Court was unreasonable. Appeal Court took their arguments in consideration, abolished the Civil Court's decision and sent the case to Administrative Board of the Tbilisi Civil Court for further discussion.
'Article 42 of the Constitution', 'Centre for Constitutional Rights' 'Egalitarian Institute' and member organizations of the Non-Governmental Organizations Coalition consider that it is the first fair decision made regarding the cases launched against Egalitarian Institute.
