Young Lawyers Consider that the Destruction of the Trade Objects Is Carrying Out Through Violating the Laws on Property

January 31, 2007

The Georgian Young Lawyers Association considers that the deconstruction of the trade objects in Tbilisi is carrying out through violating the legislation. They are breaching the law on property. It was stated in the announcement, spread by the press service department of the association.

“Under the Georgian Legislation, if the object is considered illegal, the Tbilisi City Supervision Service must involve the owner in the investigation and pass the verdict according to the principles of transparency. If the investigation concludes that the building is illegal, the deconstruction of the building can be considered as one of the methods of punishment. The law categorically defines that the owner should receive the warrant about deconstruction within 24 hours after the verdict is passed. The owner can appeal against the verdict within fifteen days,” the announcement stated.

The announcement also stated that the recent deconstructions of the buildings in the city are being carried out through violating those norms.
“The owners are not delivered the warrants of the decisions they make against them. Thus the owners cannot appeal to the court and protect their rights,” said the announcement.
