Nora Kvitsiani’s Lawyer Blames Judge for Partiality

In Zugdidi, Gali-Gulrifshi district court started to discuss the case of Nora Kvitsiani-Arghvliani, a sister of Emzar Kvitsiani. The criminal case against Nora Kvitsiani is launched under several articles. She is accused for establishing the illegal armed formations, illegal storage of weapons and appropriating the state funds of 75 000GEL while she was a governor of the village. Nora Kvitsiani was detained on July 26 2006 during the famous events that took place in the Kodori Gorge. Before detention she was a governor of the village of Ajara in the gorge. Nora Kvitsiani refused the accusations against her and said that she was punished for having rescued the gorge.

Kvitsiani’s lawyer, Paata Chukhua demanded the process was not conducted by the judge Davit Kekenadzs. The reason of his demand was his unsatisfied mediations. Neither prosecutor, nor the judge followed his demands. Kekenadze considered lawyer’s demands unreasonable.

One of the Kvitsiani’s lawyers, Chukhua considered the court process is negative. He said the court hearings are conducted partially. “We were explained today that no proofs would be investigated. Thus I can predict the verdict of the process-I do not doubt that the accused will be found guilty in every accusation that is produced by the prosecutor. The court has not satisfied any of my mediations. The judge seems to be biased to me,” said Chukhua.

The accusations against Nora Kvitsiani are unreasonable according her family members too. Her sister Lali Kvitsiani said: “It is a show where the judge follows prosecutor’s orders and they cooperate.”

The prosecutor introduced three witnesses at the trial, one of whom denied the testimony he had made during the preliminary investigation and said that he had signed the document under the investigator’s order. After that the lawyer demanded to interrogate the investigator; however the judge did not satisfy his mediation like many others.

The defense side has not introduced its witnesses. The process will be renewed on Marhc 19. The lawyer said that verdict on Kvitsiani will be passed on that day.
