Human Rights Centre Blames the Chairwoman of the Telavi District Court for Blatant Violation of Human Rights

May 4, 2007

Human Rights Center blames Marika Tsertsvadze, chairwoman of the Telavi District Court, for partiality and blatant violation of the human rights.

Today, Telavi District Court discusses criminal case on Besik Mrelashvili, a patrol policeman. He is accused for having violated traffic rules. He was drunk when driving a car on March 26 2007 in Telavi and crashed twenty-year-old Giga Charbadze. Badly injured boy was taken to hospital where he died.

Kakheti Regional Prosecutor’s Office launched criminal case under the Georgian Criminal Code, Article 276, Section VI. On May 1 the Prosecutor’s Office introduced the case to the Telavi District Court for further discussion. On May 2, soon after accused Mrelashvili was handed in the bill of particulars, trial was postponed for May 7 to satisfy the mediation of victim side. However, Mrelashvili’s lawyer, Tamar Metreveli informed the Human Rights Center that the judge Marika Tsertsvadze, a member of the Council of Justice, postponed the court hearing for May 4 and the lawyer learned about it several hours before the hearing started. Metereveli could not appear at the court hearing and demanded to postpone it for May 7; the judge satisfied the mediation. Accused Mrelashvili was forced to hire state attorney. According to the initial information, Besik Mrelashvili will be arrested. Previously, he was released as a result of the Judge Lia Otarashvili’s decision to bail him.

Human Rights Centre monitors the court proceeding of the case. They have observed many violations and it is obvious that Mrelashvili’s rights are blatantly violated. The centre is deeply concerned regarding the situation and demands corresponding bodies to react on the fact.
