Sozar Subari: Batiashvili’s Rights Were Violated While Discussing Case Materials on Him

Public Defender, Sozar Subari stated that while discussing the case materials on Batiashvili, the rights of the condemned were violated and it seriously influenced the court when passing the final verdict. “The verdict is groundless and cannot introduce valid proofs,” said Public Defender.

The Ombudsman defined that Batiashvili was charged under the Georgian Criminal Code, Articles 25, 307, 315 Section III and Article 376. The charge was based on the records of over-phone conversation between Batiashvili and Emzar Kvitsiani from July 23 to July 25 2006.

Subari stated that the case materials prove that the investigation had neither audio records of over-phone conversation nor its clarified variant.

On August 2, 2006 the record was enclosed to criminal case materials as a proof.

Based on the studied materials, Sozar Subari said that the decision of the Criminal Collegium within the Tbilisi Civil Court is groundless and cannot introduce valid proofs, which is blatant violation of the law. Seeing that the judge violated the law during the discussion of the criminal case and while passing the verdict against the leader of “Tsin Sakartvelo” (Go Forward Georgia), the Public Defender applies to the Supreme Council of Justice to launch disciplinary proceeding against Judge Maia Tetrauli.
