Department for Constitutional Security Detained Brother of Qibar Khalvashi

October 19, 2007

Yesterday, at approximately 10:00 PM officials from the Department for Constitutional Security detained Niaz Khalvashi, brother of Qibar Khalvashi in the Era Street in Batumi. Ramin Papidze, an attorney for the detainee, was not allowed to meet him.

“I do not know the ground for the detention of my client. His constitutional right on the defense was violated,” said Papidze.

The only person who met Niaz Khalvashi was Giorgi Charkviani, Public Defender’s representative in Adjara region. Charkviani stated that at the midnight Tengiz Pataridze, the head of the Department for Constitutional Security, told him that Khalvashi was not arrested. “Pataridze told me they were going to discuss some issues with him. Though, nobody let Khalvashi leave the department after discussion. Khalvashi stated he did not need the assistance of the attorney yet.”

Charkviani tried to meet Khalvashi late in the night again but the security guard did not let him enter the department. Public Defender’s representative is going to appeal against the guard for not having allowed him into the building.

Nobody knows where Niaz Khalvashi is. Representative of the Public Defender stated that the detainee was not registered on the list of pre-trial detention setting. The attorney does not know his location either.
