Young Lawyers Association (GYLA) Appealed to the Court against Tbilisi City Hall

GYLA intends to appeal to the court against the Tbilisi City Hall.

Kakha Kozhoridze, the lawyer representing the GYLA, reported to Medianews that the association is blaming the City Hall for breaching property owners’ rights. Owners Omar Gotsadze and Zaal Kikvadze, who own 370 sq. meters of land along Chikovani Str. in Tbilisi, had registered their properties in the Public Registry. However, on November 18, 2007 workers of the “Skhivi Ltd”, under the order of the Public Service Department within the Tbilisi City Hall, began construction activities without asking for permission from the legal owners of the property.

Based on the GYLA’s appeal, Tbilisi Appeal Court prohibited the Ltd to continue construction works on the property. Still, before the court proceeding finished, the Ltd managed to build a wall of several meters height around the area. On April 24, 2008 the company, unshaken by the court order, continued with its plans and started to install amusement rides and fixtures on the territory.

Kakha Kozhoridze stated that the association had appealed to the City Hall and said that a one-month period for consideration had expired on May 3. “According to the activities of the City Hall, we do not hope the court will satisfy our appeal. Therefore, we will sue the Administrative Collegium of the Tbilisi City Hall. We will demand that illegally constructed wall and amusement fixtures there be dismantled,” said Kozhoridze.
