Winning Company Cannot Implement Agreement Conditions

Humanrights.ge was reported that Ltd Terex does not rehabilitate Queen Tamar, Kvirkvelia, Agmashenebeli, Ninoshvili and Chkhaidze Streets in Lanchkhuti. The tender sum for the rehabilitation of the streets was 1, 9 million lari. The aforementioned company won the tender. According to the agreement, Terex had to finish the rehabilitation work before December 4, 2013.

Despite that, chairman of the Infrastructure Commission of the Lanchkhuti Sakrebulo Merab Tsilosani said the Ltd has not implemented 30% of the work either. “According to the agreement, the company has to finish the rehabilitation activities before December 4, 2013. They have won tender of over 1 million lari and leadership of this company does not feel responsibility at all. It is clear that they breached the term and will have to pay fine; but the main problem is that the company does not care about the fine – they will continue working even after paying the fine. However, it is interesting whether the asphalt paved in December will be of high quality or not. We are not eager to fine somebody, we want the company to do its job,” Tsilosani said.

We interviewed chairman of Lanchkhuti Sakrebulo Amiran Gigineishvili about the fact. “They have to asphalt five streets in Lanchkhuti. Terex does not implement its duties. They won tender, we signed agreement but they have not even launched activities. They brought graders twice and that was all. I called company director but he did not answer my phone calls. Then I sent him message introducing myself but he did not reply. Finally, I had to petition to the Ministry of Infrastructure. They said we have to put the company on the black list because Terex has same problems in other districts too,” Gigineishvili said.

Lanchkhuti district governor Zaza Urushadze told us the deadline for the implementation of the rehabilitation activities is December 4. “The company won tender for more than one million lari but have not even launched activities. I sent three letters to them demanding to implement their duties but in vain. The company provided guarantee letter on 50 000 lari from the bank and then started implementation of the project. Now, we have to request the guarantee sum and drop agreement with the company. Of course we will act in accordance to the law. Afterwards, we will sign new agreement with another company though initially we have to agree all issues with the Ministry of Finance. Presumably, everything will happen so, because Terex did not implement any of its duties,” the governor said.

Humanrights.ge tried to contact Terex leadership but in vain. The director did not answer our phone calls.
