Human Rights Defenders Speak About Breached Labor Contracts

Last month, two resonant cases of breached labor contracts and employees’ rights occurred in Gori,- chairperson of the Gori office of the Georgian Young Lawyers’ Association Keti Bebiashvili said when commenting on the suspended labor contracts with two teachers of Khidistavi Public School and about cabal labor contract offered to the employees of TV-Company Dia by the company administration; the latter resulted into resignation of 12 employees at the company. Keti Bebiashvili said these two examples show that public and private companies breach the employees’ rights.

Keti Bebiashvili: “Problems were observed in the labor relations. One fact was observed in Khidistavi public school and second in the TV-Company Dia. In the Khidistavi Public school director did not extend labor contracts with two out of four dismissed teachers because they did not apologize to him in written form. The labor contract offered by the administration of the TV-Company Dia to its employees was also problematic. According to the contract, journalists did not have right to continue working in the rival TV-Company for the next three years after quitting the TV-Company DIA. Both parties shall follow the labor code. Neither employer nor employee shall offer such conditions to the opposite side which will contradict the law and breach human rights.”

Lawyer of Human Rights Center’s Shida Kartli office Elza Kerdikoshvili said labor rights and contracts are still very often breached in the region and many citizens have already applied to their office for help.

Elza Kerdikoshvili: “We are studying several cases on breached labor rights. One case is against the building company NOVA whose employees implemented the work in accordance to the labor contract but the company did not pay salaries of last few months to them. After the consultation with us, the victimized party started collection of documents and Human Rights Center will take their case to the court.”

Human rights defenders say they observe one more general tendency apart to the breached labor rights – the requirements of the labor agreements frequently contradict the Labor Code of Georgia.
