Address of Human Rights Center about Alleged Inhuman Treatment of a Convicted Woman

Human Rights Center requests investigation into alleged inhuman treatment of an inmate in Prison # 5. 

In August convicted Nana Parchukashvili from Prison # 5 lodged lawsuit to the Constitutional Court of Georgia with the support of the Georgian Young Lawyers’ Association. In her constitutional lawsuit she requested to declare degrading procedure of the full examination of convicts as non-constitutional. Nana Parchukashvili informed monitors of Human Rights Center about the degrading full examination which was later reflected in the report of the organization “State of Women and Juvenile Prisoners in Georgia.”  

Convicted Nana Parchukashvili said in her statement to the lawyer of Human Rights Center that after the constitutional lawsuit was drafted and she signed it, the administration of the prison # 5 delayed approval of the court credence and as a result Nana Parchukashvili could not timely send the appeal to the Constitutional Court.

According to Nana Parchukashvili, before lodging lawsuit to the Constitutional Court, prison administration oppressed her to change mind and not appeal to the court.

Convicted Parchukashvili stated in her explanation letter that a prison officer threatened her for having appealed the court.

On August 12, 2015 Nana Parchukashvili started hunger strike and prison director informed NGOs, Public Defender’s Office and Ministry of Corrections and Legal Aid about it. Parchukashvili requested to stop her oppression from the side of the Prison # 5 administration. 

According to Nana Parchukashvili’s clarifications, on August 14 she was abused by prison personnel and prison administration members and director of the Prison # 5 also participated in her physical assault.

The convicted person appealed to the General inspection and requested investigation into the fact as well as punishment of the prison personnel. The General Inspection replied to her that they had finished investigation into the alleged violation but could not detect administrative violation or any illegal action in their activities.

Nana Parchukashvili has been requesting video-recording of her physical assault on August 14 in vain.

On September 17, Human Rights Center addressed to the Chief Prosecutor’s Office and requested to investigation alleged fact of intimidation of the prisoner by the personnel of the Prison # 5.

Human Rights Center calls on:
 The Minister of Corrections and Legal Aid to take adequate measures and impartially study alleged facts of abuse of the convicted Nana Parchukashvili in Prison # 5.
 The Chief Prosecutor of Georgia to timely and effectively investigate alleged inhuman treatment of the convicted Nana Parchukashvili in Prison # 5.
 Human Rights Committee of the Parliament of Georgia to study the petitions of the convicted Nana Parchukashvili and conduct effective parliamentary control over the activities of the Chief Prosecutor’s Office.
