Address of Human Rights Center to the Chief Prosecutor’s Office about Rusudan Purtskhvanidze’s Case

Human Rights Center believes the practice of investigative bodies is inadmissible when they forward cases for further investigation to the institutions, which may be biased about them. 

Human Rights Center assists Rusudan Purtskhvanidze, victim of fraud, with legal aid. The case may refer to illegally issued visa in the Embassy of Greece, for what Rusudan Purtskhvanidze was deported from Hungary to Georgia.

Former employee of a district unit of the Ministry of Internal Affairs of Georgia Z.N. promised Rusudan Purtskhvanidze to help her in getting visa and other travel documents for what he received a honorarium of 5 000 EURO. After deportation, Rusudan Purtskhvanidze claimed the money back. On April 15, 2016 she appealed the Chief Prosecutor’s Office which forwarded her appeal to the Kutaisi district prosecutor’s office. The latter forwarded the case to the unit of the MIA where Z.N. worked in the past.

As a result of fraud, Rusudan Purtskhvanidze received not only material but also moral damage. Based on the visa issued by the Greek Embassy she was traveling around EU but was suddenly arrested in the airport of Hungary; she spent three days in unbearable conditions of the detention setting. During deportation she was clarified the visa was illegally issued.

Human Rights Center believes the Chief Prosecutor’s Office shall investigate the case of Rusudan Purtskhvanidze. Although she paid 5 000 EURO to the person in Kutaisi, the scope of the crime is not only one city and signs of the crimes are identified in Tbilisi too. At the same time, investigation of the case by Kutaisi police unit, where the accused person had worked, creates doubts that the investigative bodies may refrain from estimating the truth in this case for their informal interests.

Human Rights Center addresses to the Chief Prosecutor’s Office to review its practice and act in respect to the principles of impartial investigation. As for Rusudan Purtskhvanidze’s case, it should be sent to the Tbilisi Prosecutor’s Office to ensure impartial and effective investigation in it.
