Prisoner Might Be Allowed to Take a Computer into the Cell

Court Accepted the Suit against Bacho Akhalaia

On September 19, Nino Oniani, judge for the Administrative Collegiums within the Tbilisi Civil Court, accepted the suit of the accused Gia Fatsuria against Bacho Akhalaia, the chairman of the Penitentiary Department.

In August of 2007 the accused applied to Bacho Akhalaia and asked permission to take a computer and printer (without internet) in Rustavi Jail # 1.

Gia Fatsuria is a journalist and continues his activities in the prison. He is writing articles there. Since 2004 Human Rights European Court has been discussing his case (envisaged under the European Convention Articles V and VI).

The law on imprisonment enables prisoner to use printer in the custody and carry out professional activities. Lawyer Manana Kakabadze, chairwoman of the organization “Constitution Article 42”, protects Fatsuria’s interest in the court. She said that “Fatsuria’s demand was based on the Law on Imprisonment according to which he has right to have a computer in the cell. However, Penitentiary Department refused him to give the right and could not give concrete reasons for the refusal. The accused appealed against the refusal and the court accepted his suit. The hearing is earmarked on October 15 2007 at 2:00 PM.
