Defense Ministry of Georgia lost trial against hero of Iraq Ramaz Mandzulashvili.Last year, Gori district court had different opinion about the case of Ramaz Mandzulashvili but it changed its attitude this year. The Ministry of Defence tried to settle the problem before the court passed judgment but the trial turned out too resonant and the court had to pass verdict against the Ministry.

The Ministry of Defense of Georgia sued hundreds of former soldiers alleging that they violated a term of the contract under which they served in the army. All these soldiers signed the contract when the Minister of Defense was Irakli Okruashvili who is in opposition to the current government of Georgia. The Ministry of Defense demands that former soldiers pay the liquidated damage specified in the contract which varies from 30 -40,000 US Dollars.

The suspects in the Mukhrovani Mutiny were subjected to pre trial detention by the Tbilisi City Court in May. The two-month pre trial detention term and the preliminary investigation are over. The Collegium on the Criminal Cases within the Tbilisi City Court will take up the case on August 21. The fate of the 42 suspects charged with participation in the mutiny will depend on the decision of Judge Jemal Kopalyan.
Family Requests Protection of their Rights Because of the Death of A Soldier

On August 9, 2008 soldier Levan Ananidze was wounded in the right leg by a shell splinter.. After medical assistance he returned home on sick-leave. Later, on September 15, 2008 he died while swimming in the sea. According to the death certificate, the reason for his death was undetermined. In this circumstance, the family should get insurance for the death of the soldier. The family has not received the sum yet because an investigation started on whether he was a suicide.

Jumber Kvariantashvili, a forty-three year old soldier, served in the Khoni military base. He died several months before the war in August war, 2008. Liana Guliashvili, his widow, stated that Kvariantashvili hurt his leg during military trainings. After the trauma he was treated at Gori hospital but his health condition did not improve and unfortunately the soldier died.

Sergeant Roin Shavadze was killed on August 16, 2008. The Nine-month period of preliminary investigation expires in a month before the court proceeding. Lawyer Ramin Papidze thinks that the investigation on the killing will not succeed during current government. We tried to find the connection between the committed crime and Georgian authority. If there are no links between the two, why does not the investigation move to the court; why and who is hindering the court from involving itself in the investigation and why.

Court VS Honor and Dignity of Soldier

On November 6, 2008 Gori district court signed plea-bargain with two soldiers who were accused for deserting the army during war operations in August 2008. According to the bargain, initial charge of the soldiers-deserting-was changed into disobedience. The attorneys of the accused people requested plea-bargain. They considered it was the shortest way to gain freedom for detainees in the expectation of the Presidential mercy. On December 17, 2008, on St. Barbare’s Day, soldiers were really pardoned and released. Everybody should have been pleased with the result but pardoned soldiers, Zurab Khorbaladze and Giorgi Meskhi are sure that impartial court should have estimated their innocence. However, the lawyers could not give them guarantee for similar decision and the accused people had to accept status of a guilty and get freedom at the expense of soldier’s honor and dignity. Whilst, they expected the court to protect their dignity.
