With Legal Assistance of Human Rights Center Tbilisi City Court Granted Refugee Status to Azerbaijani Citizens

Today, on June 23, Tbilisi City Court held a trial into the case of Azerbaijani citizens Dashgin and Orkhan Agalarlis, father and son, who requested refugee status in Georgia. Head of the legal aid service of Human Rights Center Tamar Avaliani defended their rights at the court.

Human Rights Center works on the case of the Agalarlis since 2014. On October 30, 2015 the Ministry of Refugees and Accommodation of Georgia groundlessly refused Dashgin and Orkhan Agalaralis to grant refugee status based on the allegation that their stay in Georgia created threats to the state security and interests. In its decision the Ministry did not verify the reasons of refusal and the threats which became ground of negative answer. On the one hand the Ministry stated that in case of return to Azerbaijan Dashgin and Orkhan Agalaralis may be subjected to political persecution, torture and murder but on the other hand the Ministry refused them to grant the refugee status in Georgia. 

Dashgin Agalarali is a member of the Azerbaijani opposition political party Musavat; he was persecuted by the Azerbaijani authority for his different political views and active criticism of the government. In 2013, the Azerbaijani government blamed Dashgin Agalarali, like many other political activists, in the evasion of tax payment though he never worked in a private company. Life and health of Dashgin Agalarali’s son Orkhan Agalarali was under threat in Azerbaijan because of his father’s activities.

In 2014, Dashgin Agalarali was arrested in Georgia when he crossed Georgian-Turkish border; he had arrived in Georgia to seek political asylum. With the support of Human Rights Center, in August, 2014 he was released from prison.

Today, the Tbilisi City Court fully shared the position of the applicants, which claimed that the Agalaralis faced real threat of being killed, tortured and politically persecuted in Azerbaijan.

The Tbilisi City Court fully satisfied the request of Dashgin and Orkhan Agalaralis – to annul the October 30, 2015 decision of the Ministry of Refugees and Accommodation and ordered the Ministry to issue new individual administrative-legal act to grant refugee status to Orkhan and Dashgin Agalaralis.
