The Torturously Killed Roin Shavadze was Summoned to Court as a Witness

The family of torturously killed Roin Shavadze was visited and told that “Roin Shavadze was summoned to Batumi City Court to Vera Dolidze.” After composing special protocol stating that Roin Shavadze passed away, the visitors left Shavadze family. This happened last Monday according to Roin Shavadze’s spouse, Tsitsino Shavadze and her lawyer Ramin Papadze who spoke with pressa.ge. We spoke with the lawyer Shalva Shavgulidze to double-check the received information.

Tsitsino Shavadze: “On December 6th, young man and a girl dressed in civil clothes visited our family and told us that Roin Shavadze was summoned to the Court to Vera Dolidze. I almost lost my mind cried - visit his graveyard and bring him from there. Supposedly the girl was a bailiff in the Court. The young man said he worked in the police.
He swore that did not know if Roin Shavadze was dead. However, after they left I found out that my neighbors told him that my son was dead. According to neighbors, the girl told the policeman not to visit me but the policeman asked her to come and they came.”

“This is an attempt to make me lose my mind and absolutely destroy me,” – added the widow of the soldier, - “I still cannot come back to my mind. When my mother found out about this, she worried and had a heart attack. We transferred her to Batumi City Hospital. Don’t they have a heart? Aren’t they people?!” – they bring a paper with a dead person’s name written on it summoning him the court.”

After the widow of Roin Shavadze notified on the occurred her lawyer Ramin Papardze, the lawyer went to Batumi City Court and found out from the judge Vera Dolidze that Roin Shavadze was interrogated as a witness in the Aslan Abashidze criminal case.

One of the lawyers of Aslan Abashidze Shalva Shavgulidze notified pressa.ge that in regards with Abashidze case, in the phase of preliminary investigation Roin Shavadze really gave a testimony.

Shalva Shavgulidze: “In my episode Aslan Abashidze was convicted in the organization of the explosion of bridges. Roin Shavadze does not have direct contact with this case; he was the specialist of this sphere and was interrogated on some circumstances superficially.

Senior Sergeant Roin Shavadze had come back home for two days from Tskhinvali war when on August 16th of 2008, in the center of Batumi, in the afternoon, the disguised special forces detained him at the Gold Market where he was physically assaulted. His wife accidentally found out about the detainment of her husband at work. When the family could not find out about the fate of Roin Shavadze, they contacted the representatives of the public defender, but they could neither ascertain the fate of Roin Shavadze.

On the same day, late at night, the policeman from the street cried out to the Shavadze family – “Roma is in the reanimation department.” When they visited the hospital, the soldier was not in the reanimation department, but in the prosektorium, where his widow and relatives were prohibited to say a word by numerous law-enforcement officers.

The open terror on Shavadze family stopped after the public defender of that time Sozar Subari gave international resonance to this case; Giorgi Targamadze spoke about the terrorizing of Shavadze family and relatives from the Parliament tribune, and New Rights Party and Republicans spoke on TV; at the session of Temporary Parliamentary Commission of August War, PM Dimitri Lortkpanidze raised a question on Roin Shavadze; the widow of soldier met with the Council of Europe Commissioner of Human Rights Thomas Hammarberg and Ambassador of France in Georgia Eric Fournier and presented the case circumstances to him.

According to the expert inference obtained by us, it is confirmed that the soldier who had come back from war for two days was tortured at first and executed afterwards. The expert Aeksandre Gejadze stated: “These damages might have been developed while he was resisting the beating.”

The preliminary investigation on Roin Shavadze’s case was filed under two articles – article 108 (intentional murder) and paragraph A of part two of article 260 (narcotic crime), that according to the existing law, might continue for 15 years. Wife of the soldier Tsitsino Shavadze has still not been acknowledges as a assignable individual of the case; Shavadze’s lawyer Ramin Papidze has not been presented with the case material.

In September of the current year, Ramin Papadze addressed the Minister of Justice of Georgia Zurab Adeishvili and the main prosecutor Murtaz Zodelava and once again requested the introduction of the case materials and acknowledgement of Tsitsino Shavadze as a an assignable individual.

This request was responded by the head of the investigation department of Adjara Office of Prosecutor Giorgi Gratiashvili where it was written: “Your request is groundless and cannot be shared since according to the provision of the Criminal Procedural Code you do not have the relevant status, you are not presenting the procedural side that could give you right to fully see the case materials.

As for acknowledging Tsitsino Shavadze as an assignable individual, I want to remind you that nowadays, the preliminary investigation does not have the relevant evidence that could grant Tsitsino Shavadze the above mentioned status. Namely, we have not obtained the additional inference of ballistic inference of expert that will promote taking thorough decision on the case.”
