Ministry of Justice of Georgia Adopts the NGO Coalition’s Recommendations Concerning Violence against Women and Domestic Violence

On August 4,representatives of the Coalition for an Independent and Transparent Judiciary, supported by EWMI-PROLoG, took part in a meeting organized by the Ministry of Justice of Georgia (MoJ)to discussadraft law package aimed at implementing the Istanbul Convention on Preventing and Combating Violence against Women and Domestic Violence.  The Coalition provided several recommendations which the MOJ included in its draft law package.  Some of the most important of recommendations if passed by Parliament will do the following:
  • Allow a police officer to issue a preventive order without waiting for court approval.  The subject of the order will be allowed to appeal the order at the court within 5 days from the moment it is issued;
  • Expand the definition of domestic violence victim to include “partners”and former partners, rather than just wives and husbands.
  • Add an article to the Criminal Code which makes “stalking” an offense. Under the new law, it will not be necessary to prove that a victim had to change her/his lifestyle to prove stalking.  It will be enough to show that a victim is confronted with a need to change her/his lifestyle because of the subject's behavior. 
  • Changes a number of articles which cover domestic violence, forced sterilization, rape, all types of sexual crimes, harassment, and stalking, in a way that aggravates the crime if the victim is proved to be a person with a disability.
The Coalition is planning continue its advocacy when the draft law is submitted to the Parliament.
